INTRODUCTION
These General Terms and Conditions ("Terms") govern your ("User", "You") use of Sicurofashion.com ("Website", "Service"), provided by Sicuro Fashion AB, company reg. no. 559430-5251 ("We", "Us").
It is important that you take the time to read and understand the Terms, which contain information about how we handle your data, what is permitted and not permitted on the Website.
The Terms apply to your use as soon as you choose to create your Account.
THE SERVICE
We provide a platform for buying and selling exclusive fashion items and enable the identification of fraud attempts in relation to the second-hand market for clothing, accessories and other products related to the fashion industry ("Service").
The Service means that every product listed on the website has a verified authenticity ("Verification"). The Verification has a 99.3% accuracy rate, meaning our methods for identifying fraud attempts are market-leading, but they do not provide a complete guarantee of product authenticity. We do, however, offer a six (6) month authenticity guarantee for products with a value of up to SEK 5,000. More information about our authenticity guarantee can be found under heading 5 "Authenticity Guarantee".
To use the Service, the User uploads the required number of images of the product to be sold, after which Verification is performed. After Verification, you receive an NFT certificate, which is a digital, non-exchangeable proof of authenticity that serves as evidence that the listed product is genuine ("Certification"). Alternatively, you may choose to receive a PDF certificate. Regardless of format, the Certification accompanies the Product.
PAYMENT
Sicuro Fashion acts as the payment recipient for all transactions on our website. This means that in all purchase and sale agreements, Sicuro Fashion is your counterpart.
In collaboration with Rocker, an external payment intermediary, we ensure a safe and secure payment process. When a Buyer makes a purchase, Sicuro Fashion receives the payment and holds it for 48 hours from the time the Buyer has received the item. This timeframe allows the Buyer to carefully verify the product's condition and authenticity. After this verification period, the payment is forwarded to the Seller, provided no problems have been reported. This system guarantees a secure transaction where payments are only processed after the Buyer has confirmed that the item matches the description and is genuine.

Payments can be made via various methods, including credit card, Swish or invoice. Our aim is to offer a safe and efficient payment process for both Buyers and Sellers on Sicuro Fashion.
RETURNS
Sicuro Fashion offers a 14-day right of return in accordance with the Distance Contracts Act. All products sold on Sicuro Fashion are second-hand. The product must be in the same condition as upon delivery when returned and must not have been used or altered beyond this. Returns are accepted for both defective and non-defective products.
In case of return due to defects, lack of authenticity or if the product does not match the description, this must be reported to Sicuro Fashion within two (2) days of receipt. In the case of an approved complaint, Sicuro Fashion covers the return shipping. For returns without a prior complaint, the buyer covers the return shipping cost. No restocking or handling fees are charged. Return is made by dropping off at an agent (drop-off location) with a shipping label provided by Sicuro Fashion. Refunds are made to the original payment method within seven (7) days after the return has been received and approved.
COMPLAINTS
If a delivered product is defective, inauthentic or otherwise does not match the Seller's description ("Faulty Product"), the Buyer must inform Sicuro Fashion within forty-eight (48) hours by written notice to info@Sicurofashion.com.
If the Buyer lodges a complaint about a faulty product and this is confirmed by Sicuro Fashion, it is the Seller's responsibility to cover the cost of return shipping. Sicuro Fashion will invoice the Seller for these costs.
CONFIRMATION OF RECEIPT AND AUTHENTICITY
The Buyer undertakes to verify the authenticity of the Product within forty-eight (48) hours of receiving it by comparing the received Product with the images attached to the Certification accompanying the Product ("Authenticity Verification").
If the Buyer discovers a discrepancy during the authenticity verification, this must be reported to Sicuro Fashion immediately and within forty-eight (48) hours of receipt. Upon such reporting, Sicuro Fashion will retain the payment made by the Buyer until Sicuro Fashion has had the opportunity to investigate the discrepancy and the product in question. To facilitate this investigation, the Buyer must return the received product to Sicuro Fashion for a detailed review ("Complaint").
The cost of transport to Sicuro Fashion is borne by the Buyer, whereby Sicuro Fashion reimburses such costs to the extent the Product proves to be inauthentic.
To the extent that Sicuro Fashion confirms the validity of the Complaint, and thus that the Product deviates from the attached Certification, the Buyer will receive a refund of the amount paid for the Product.
To the extent that Sicuro Fashion cannot confirm the validity of the Complaint, and thus maintains that the Product is genuine, the payment for the Product will be credited to the Seller.
AUTHENTICITY GUARANTEE
Buyers who, within six (6) months of a completed purchase, can prove probable circumstances that the Product deviates from the Certification, are entitled to claim back the purchase price up to a maximum of SEK 5,000.00, whereby Sicuro Fashion is responsible for refunds up to said amount ("Authenticity Guarantee").
"Probable circumstances" means images and information demonstrating that the Product deviates from the Certification, whereby Sicuro Fashion is entitled to request the Product for further investigation. Sicuro Fashion is responsible for transport costs in connection with such investigation.
MARKETING
Sicuro Fashion has the right to use the Seller's provided images and name for marketing purposes on our platform. This right is limited to the period until the product is sold.
ACCOUNT & GDPR
In order to use the Website, you need to create a user account ("Account"), which is used to take advantage of the features offered by the Website, including buying and selling functions.
You create your Account using BankID, after which we will request personal information in the form of first and last name, email address, delivery address and phone number. This information is stored by us and handled in accordance with our Privacy Policy, which you can access through our website, www.Sicurofashion.com.
USER OBLIGATIONS
As a User, you undertake during your use of the Website and the Service to;
- Not use the Service if you are under 18 years of age,
- Provide us with accurate information,
- Only sell original products and not copies or imitations of original products (for clarification, original products means products whose manufacturer is the same as the brand the product bears)
- Not seek to sell copied or imitated products,
- Carry out each transaction in accordance with these Terms and not prevent purchases and sales from being completed in accordance with what is stipulated herein.
Sicuro Fashion is entitled to charge Users a penalty fee of SEK 200.00 to the extent that;
- A User uses the service to sell products that upon Authenticity Verification prove to be counterfeit,
- A User fails to ship a sold item within five (5) days of a completed transaction (purchase & sale).
CONDUCT & COMMUNICATION
When you create and use your Account, you agree to comply with our policy regarding communication and behaviour on the Website ("Policy"). Deviations from the Policy are strictly prohibited and may result in a permanent ban from using the Service;
- Use of offensive or negative language,
- Spreading false, misleading or inflammatory information,
- Disrespect of any kind; including hate speech based on but not limited to race, religion, gender identity, sexual orientation, disability or nationality.
- Personal attacks, harassment, identity theft or bullying of other Users.
- Violations of privacy or sharing of personal information
- Depictions, references or descriptions of graphic violence or explicit/implicit sexual content.
- Breaking the law, planning crimes or describing illegal activities.
- Threats to harm other Users, even if expressed in terms of a joke.
- Distribution of unauthorised copyright or trademark protected material.
FEES
All fees are presented inclusive of VAT.
Brokerage Service, Consumers
The Seller is charged a fee of 10% in service fee plus 3% in payment fee of the product's value upon completed sale.
Brokerage Service, Business
Sellers who are businesses are charged a fee upon sale according to a separate agreement with Sicuro Fashion.
Verification
Upon performed Verification regarding the product's authenticity, a fee of SEK 120.00 is charged.
If the Buyer chooses to receive the Certification in the form of an NFT, a fee of SEK 99.00 is added.
Shipping
Shipping is paid by the buyer and is calculated based on the products' weight and dimensions and is stated when completing a purchase.
VIOLATIONS
To the extent that a User deviates from what is stipulated in these Terms, Sicuro Fashion is entitled to permanently ban the User from the account. If the deviation causes damage to Sicuro Fashion or another User, such offending User shall be liable to pay compensation corresponding to the damage incurred.
Sicuro Fashion reserves the right to use legal means to obtain compensation for claims arising from the User's deviation from the Terms.
LIABILITY
We are not liable for indirect damages or consequential damages that users may suffer as a result of using the Website or the Service, except as stated in these Terms.
This includes, but is not limited to, lost profits, loss of business opportunities, data loss or other intangible losses, even if these damages result from deficiencies in the Service or if We have been informed of the possibility of such damages.
We are not responsible for actions, behaviours, statements or information provided by other users or third parties on the Website, including product authenticity (except as stated in section 7, "Authenticity Guarantee") and product quality.
We cannot be held liable for delays or failures in performing our services caused by circumstances outside our reasonable control, such as natural disasters, war, terrorism and similar force majeure events.
We take no responsibility for the accuracy, completeness, reliability or timeliness of information or material provided on the Website, except as stated in the Terms.
The availability of the Service is not guaranteed to be uninterrupted or error-free, and We shall not be held liable for any interruptions, delays or errors in the Service.
This limitation of liability constitutes an essential part of the General Terms for the use of Sicuro Fashion and its Services. By using the Website and the Service, you acknowledge and accept these limitations and disclaimers.
CLOSING
We reserve the right to adjust and correct the content of these Terms, and reserve the right to issue final Terms to the extent that these are found to contain obvious typographical errors or ambiguities.
APPLICABLE LAW
Swedish law shall apply to the interpretation of the Terms.
In the event of a dispute, the District Court of Gothenburg shall be the court of first instance.
